Terms of service

These Terms of Service govern your access to and use of https://pexlumi.com/ and your purchase or use of products and services offered under the Pexlumi brand.
The website and services are operated trading as Pexlumi.
By accessing the website, placing an order, approving a quotation or using a Pexlumi product, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to place an order.
Where you place an order on behalf of another person, family, company or organization, you confirm that you have authority to act for them.
2. Pexlumi services
Pexlumi may offer:
- Digital invitation templates;
- Custom invitation images;
- Animated invitations;
- Invitation videos;
- Wedding and event invitation websites;
- Hosted invitation links;
- RSVP forms;
- Music and multimedia integration;
- Custom domain assistance;
- Guest-management features; and
- Related design and digital services.
The exact deliverables, features, revisions, delivery time and hosting period are those stated on the product page, quotation, project brief or order confirmation.
3. Product information
We make reasonable efforts to display accurate descriptions, demonstrations, previews and prices.
Sample invitations may contain demonstration names, photographs, text, animation, music and event information. Unless specifically stated, sample content is not included as customer-owned content and will be replaced during customization.
Colors, dimensions, animation speed and appearance may vary depending on device, browser, screen, operating system and internet connection.
4. Orders and acceptance
Submitting an order does not by itself require Pexlumi to accept the project.
An order is accepted when:
- Payment has been successfully received;
- Required customer information has been provided;
- Pexlumi confirms acceptance; and
- Any applicable project brief or quotation has been agreed.
We may decline or cancel an order where:
- Required information is missing;
- Payment cannot be verified;
- The requested content is illegal or infringes third-party rights;
- The requested deadline is not feasible;
- The product was incorrectly priced due to an obvious technical error; or
- Fulfilling the order would create a security, legal or operational risk.
Where Pexlumi cancels an order without having provided the service, the applicable payment will be refunded.
5. Prices, taxes and payment
Prices are displayed in the currency shown at checkout.
Applicable taxes, fees and optional charges will be shown before payment wherever required.
Payments are processed using the payment methods available at checkout. Payment providers may have separate terms, security procedures and processing times.
The customer must not initiate an improper chargeback for a validly delivered order. A genuine payment dispute should first be reported to Pexlumi so that it can be investigated.
6. Customer information and materials
The customer must provide accurate, complete and timely information required to complete the order.
The customer remains responsible for:
- Correct spelling;
- Event dates and timing;
- Venue details;
- Map links;
- Names and family information;
- Photographs and videos;
- Contact information;
- RSVP questions;
- Music requests;
- Religious or cultural wording; and
- Any other customer-supplied content.
Delivery schedules may be extended where the customer delays providing content, approvals or feedback.
7. Rights to submitted content
The customer retains ownership of original photographs, text, videos and other content supplied by the customer.
The customer grants Pexlumi a limited license to copy, edit, resize, format, host, transmit and otherwise use that content only as reasonably necessary to:
- Fulfil the order;
- Provide customer support;
- Host the invitation;
- Create backups; and
- Comply with legal obligations.
The customer confirms that they have all permissions, licenses and consents required for submitted content.
8. Prohibited content
Customers must not submit content that:
- Infringes copyright, trademark, privacy or publicity rights;
- Is unlawful, fraudulent or misleading;
- Contains malware or harmful code;
- Promotes violence, hatred, discrimination or illegal activity;
- Exploits or endangers children;
- Contains intimate material shared without consent;
- Impersonates another person; or
- Violates applicable law.
Pexlumi may refuse, suspend or remove prohibited content.
9. Music, photographs and third-party material
Customers requesting a particular song, photograph, video, font, artwork or other third-party material must have the right to use it.
Pexlumi may refuse to include unlicensed material or may substitute appropriately licensed content.
A customer-supplied music file or image does not transfer ownership or licensing responsibility to Pexlumi.
10. Drafts, revisions and approval
Pexlumi may provide previews or drafts for approval.
The customer must carefully review each preview before giving approval. Approval may be provided by email, WhatsApp, website form or another documented communication method.
The product includes only the number of revisions stated in the product description or order confirmation.
After approval:
- Customer-requested changes may incur an additional fee;
- Substantial redesign may require a new quotation; and
- Pexlumi will remain responsible for correcting mistakes introduced by Pexlumi.
11. Delivery
Digital products may be delivered through:
- Email;
- Download link;
- Customer account;
- WhatsApp;
- Cloud-storage link; or
- A hosted Pexlumi invitation URL.
The customer is responsible for providing a correct email address and telephone number and for checking spam or filtered folders.
Delivery estimates begin only after payment and all required content have been received.
12. Hosting and invitation availability
A hosted invitation is provided for the period stated on the product page or order confirmation.
Unless separately purchased:
- Hosting is not permanent;
- The customer does not acquire ownership of Pexlumi’s servers, hosting account or shared domain;
- The invitation may be deactivated after the hosting period;
- Continued hosting may require a renewal fee; and
- Pexlumi does not guarantee permanent storage of the project after expiry.
Pexlumi may temporarily suspend an invitation for maintenance, security issues, legal requirements, non-payment or prohibited content.
13. RSVP functionality
Where RSVP functionality is included:
- Pexlumi provides the technical facility for collecting responses;
- The customer determines what information guests are asked to provide;
- The customer is responsible for using guest information appropriately;
- Pexlumi does not guarantee that guests will submit responses; and
- Customers should independently retain important guest information.
Pexlumi is not responsible for inaccurate information submitted by guests.
14. Customer license
After full payment, Pexlumi grants the customer a limited, non-exclusive, non-transferable license to use the final invitation for the customer’s personal event.
Unless expressly permitted in writing, the customer may not:
- Resell a Pexlumi template;
- Redistribute editable or source files;
- Extract or copy design components for commercial use;
- Claim Pexlumi’s original design as their own commercial template;
- Use the product to create competing products; or
- Remove copyright, trademark or licensing notices from source materials.
15. Pexlumi intellectual property
The Pexlumi name, logo, website, software, template structure, animation, code, artwork, graphics and original design elements are owned by or licensed to Pexlumi.
Customer payment purchases the stated finished deliverable and license, not Pexlumi’s underlying source code, development tools, editable working files or intellectual-property rights, unless expressly agreed in writing.
16. Portfolio use
Pexlumi will not publish customer photographs or personal invitation details in its public portfolio without permission, except where the customer has expressly agreed to portfolio or promotional use.
An anonymized or demonstration version may be created using substituted names, images and event details.
17. Third-party services
Pexlumi products may use third-party services such as Shopify, payment gateways, Google Maps, fonts, analytics, messaging applications, video services, hosting providers or social-media platforms.
Third-party services are governed by their own terms and may change, suspend or discontinue features independently of Pexlumi.
Pexlumi will make reasonable efforts to provide an alternative where a third-party change materially affects a paid feature.
18. Availability and maintenance
We aim to keep our website and hosted invitations reasonably available. Temporary interruption may occur because of:
- Maintenance;
- Hosting-provider issues;
- Internet or telecommunications failures;
- Security incidents;
- Software updates;
- Third-party outages;
- Government restrictions; or
- Events beyond reasonable control.
Planned maintenance will be carried out with reasonable care to minimize disruption.
19. Disclaimer
Pexlumi provides invitation design and digital-delivery services. We do not guarantee:
- Attendance at an event;
- Guest responses;
- Successful delivery by every messaging or email provider;
- Accuracy of third-party map or venue information;
- Continuous availability of third-party platforms; or
- Identical appearance on every device.
Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.
20. Limitation of liability
To the maximum extent permitted by law, Pexlumi will not be liable for indirect, incidental, special or consequential loss, including loss caused by:
- Customer-supplied incorrect information;
- Unauthorized forwarding of an invitation link;
- Third-party platform failure;
- Loss of guest responses not independently backed up;
- Event cancellation;
- Customer device incompatibility outside stated requirements; or
- Use of unlicensed customer-supplied content.
Where liability cannot be excluded, Pexlumi’s aggregate contractual liability will ordinarily be limited to the amount paid for the affected order.
This limitation does not apply where prohibited by law or to liability arising from fraud, willful misconduct or any right that cannot legally be limited.
21. Indemnity for customer-supplied content
The customer agrees to be responsible for claims arising from content supplied by the customer that infringes another person’s copyright, privacy, trademark or other legal rights.
This provision does not apply to material independently supplied or created by Pexlumi.
22. Force majeure
Pexlumi will not be responsible for delay caused by circumstances reasonably beyond its control, including natural disasters, widespread internet failures, government action, civil disruption, war, epidemic, power failure or major third-party infrastructure outages.
Pexlumi will take reasonable steps to resume the service and communicate material delays.
23. Suspension and termination
Pexlumi may suspend or terminate access where a customer:
- Fails to pay an amount due;
- Uses the service unlawfully;
- Infringes third-party rights;
- Attempts to compromise system security;
- Abuses staff or support systems; or
- Materially breaches these Terms.
Where appropriate, the customer will be given an opportunity to correct the breach.
24. Governing law and disputes
These Terms are governed by the laws of India.
The parties should first attempt to resolve a dispute through Pexlumi’s grievance process.
Subject to mandatory consumer-protection jurisdiction, courts and competent forums located in [Bengaluru, KA] will have jurisdiction.
Nothing in this clause prevents a consumer from approaching a consumer commission or authority having jurisdiction under applicable law.
25. Changes to these Terms
We may update these Terms to reflect changes in our services, law or business practices.
Changes will apply from the updated effective date and will not retrospectively reduce rights already attached to a completed order.
